Roads: THE PATH TO PROPERTY -- WHO OWNS THE ROAD AND WHERE DOES IT EXTEND? 

How do you know who owns the underlying roadbed? When does a deed run to the center of the road, and when does it not? If it doesn't, who actually owns the road? What is "dedication?" Does it mean fee-simple to the government, or is it really a public-use easement? What's the difference between dedication and prescription? When does Real Property Article Section 2-114 kick in, and what does it mean in plain English? What caveats apply? How do implied easements impact roadway ownership? Leininger will explain these distinctions step by step. Beyond statutes, subtle nuances abound in case law. In many instances courts established the road-ownership doctrines we follow today, not the state legislature or county governments. Maryland's leading cases will be examined. This discussion will be of interest to surveyors and title professionals charged with rendering opinions on "the paths to property."

 

The Killer Expert Witness -- HOW TO BE THE GUY IN COURT EVERYONE WANTS ON THEIR SIDE

What are the secrets to becoming the expert everyone listens to in the courtroom? Here's a hint: the preparation begins now, if it hasn't already, not after the dispute erupts. This seminar will explore the traits and practices that will tip the balance heavily in your favor when involved in litigation. Equally as important, how and when to tell your client they have a losing case. Pre-trial posturing; depositions; discovery; hearings: all good stuff (and potentially very profitable). Want to anticipate how the opposition will react? The chances are that it will be surprisingly easy to do so. What then? Come and find out.
