Dedications – Intended and Implied, by Plat or Otherwise: and Evidence of Undocumented Easements and “Rights-of-Way”

Is the grant a dedication or is it in fee simple? Or, could it be an implied dedication?  Was the dedication created by plat or by usage? And, what evidence is there of it being an easement or a “right-of-way”?  All to be explained on the background of the recent Maryland case of Nathans Associates  v. The Mayor and City County of Ocean City; Plus, an encore visit back to Hungerford v. Hungerford, dealing with a 40 year conflict between 2 brothers (and their wives!) over a one acre parcel of land, and the importance of the word “hostile” in an adverse possession context.

Beware the Underground: What You Don’t Know Can Hurt You – An Introduction to Subsurface Utility Detection, Surveying and Mapping

This session provides an introduction to the art and science of subsurface utility surveying and mapping as it is currently practiced.  Increased congestion in utility corridors due to redevelopment activities, increasing demand for improved data for design and the need to reduce construction delays due to unexpected utility encounters are addressed. Topics will include controlling risks of utility conflicts and damage prevention through data collection, management and distribution to design and construction team members, standards of practice including ASCE Standard 38-02:  Standard Guideline for the Collection and Depiction of Existing Subsurface Utility Data, instruments and procedures and recent developments in detection and mapping equipment.
